A BRIEF OVERVIEW OF T&CS

PAYMENT POLICY

To reserve a spot on a specified retreat, a non-refundable deposit of £500 is required upon booking. Once payment has been received, a confirmation will be emailed to you to confirm your reservation. Full payment (the balance) must be made within 90 days of the retreat start date. XPLR allows guests to pay for their retreat over three instalments; payment agreements can be drawn up once your deposit has been received. Prices are based per person and do not include flights. Rooms are based on either single or double occupancy, allowing you to travel solo or with a friend. Room shares with other retreat guests may be available upon request. Please contact hello@xplr-retreats.com before booking a double room so we can advise if another guest is looking to do the same. Room shares will be offered to same sex individuals, if available.

 

TRAVEL INSURANCE

Guests must have adequate travel insurance to cover all activities listed. Please note, even if you have private health insurance in the United Kingdom or your respective Country of residence, it is unlikely that this insurance will cover overseas trips such as the retreats offered by XPLR Retreats. It is your responsibility to organise suitable travel and health insurance. You are to acknowledge that XPLR Retreats cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially, or otherwise.

 

CANCELLATIONS DEFINITIONS

“Cancellation” is defined as not attending your scheduled retreat, including postponing or rescheduling. “You” refers to the guest booking an XPLR Retreat. “We” refers to XPLR Retreats. It is your responsibility to read and understand our cancellation policy before making a reservation. Naturally, no one books with the intention of cancelling or postponing their retreat, but unexpected things do happen, so please consider purchasing travel cancellation insurance.

 

TRAVEL CANCELLATION INSURANCE

Depending on the policy and conditions, travel cancellation insurance may pay for some or all cancellation fees. Strictly for informational purposes and not to be relied upon, with most agencies, this type of insurance must be purchased within 14 days of making your reservation to optimize your level of protection.

 

GUEST CANCELLATION POLICY

Depending on when you cancel, cancellation fees may apply. Fees are determined by the following schedule (“the Cancellation fee schedule”):

 

CANCELLING WITHIN 24 HOURS OF MAKING A BOOKING

Once you have confirmation of your booking you have a further 24hrs to cancel and obtain a full refund, including deposit. After this period, the following conditions will apply.

150 DAYS OR MORE

A 75% refund minus 5% admin charge (5% of the total retreat) will be provided for all cancellations up to 150 days prior to start day of the booked retreat. This excludes the £500 per person deposit which is non-refundable.

BETWEEN 149-120 DAYS

A 50% refund will be provided on cancellations between 120-149 days prior to the start date of the booked retreat. This excludes the £500 per person deposit which is non-refundable.

BETWEEN 119-90 DAYS

A 25% refund will be provided on cancellations between 90-119 days prior to the start date of the booked retreat. This excludes the £500 per person deposit which is non-refundable.

LESS THAN 90 DAYS

No refund will be provided on cancellations between 89-0 days prior to the start date of the booked. Cancellations less than 90 days before the start date are non-refundable and will result in 100 % loss of revenue.

Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason. We do not offer credit for arriving late or leaving early.

 

CHANGING YOUR RETREAT

For all bookings, we offer guests the flexibility to change or postpone their holiday up to 150 days before the first day of your retreat. Your retreat fee will be transferred to another holiday, however due to commitments which we may have already made with our partners, in some instances a full balance transfer may not be possible. Please be understanding of our commitments with resorts to book accommodation on behalf of our guests and the legalities we are bound by. Additional fees may be incurred should you choose a retreat of higher cost. Please note that a £250 per person administration fee will be applied if you decide to choose a different retreat. No refunds will be given should you choose a cheaper retreat, however, you will be issued with a credit to use towards future bookings.

 

XPLR RETREATS CANCELLATION POLICY

If XPLR Retreats must cancel for any reason you are entitled to transfer your full retreat payment to another retreat (either scheduled or at some future time). Alternatively, you may request a refund of your applicable payment, which will be accommodated for insofar as is possible, taking into consideration any non-retrievable costs to which we committed in anticipation of your retreat.

XPLR Retreats is not responsible for your expenses incurred in preparation for any cancelled retreat such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.

 

PASSPORTS, VISAS & DOCUMENTS

It is the responsibility of each participant to obtain a valid passport, visa(s) and necessary certificates for any country to be visited in connection with an XPLR Retreat. Please ensure your passport has at least 6 months left on it before it is due to expire. If in doubt, please contact hello@xplr-retreats.com and we will be able to advise you on the requirements needed to visit your retreat destination.

 

THIRD PARTIES

XPLR Retreats holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on a retreat as compared with the advertised nature of the service.

 

GENERAL WAIVER

You acknowledge that during a retreat you participate voluntarily in any and all activities arranged by the retreat organisers, and insofar as legally permissible, surrender your right to any cause of action against XPLR Retreats arising from any loss or damage to person or property that occurs during a retreat.

 

PHOTO/VIDEO RELEASE FORM

I hereby grant to XPLR Retreats the absolute and irrevocable right and unrestricted permission to use photographic portraits, images, videos in which I feature that are taken during the course of the retreat to use / republish / copyright, etc. for commercial use in association with XPLR Retreat’s business. I hereby release and discharge XPLR Retreats from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

 

COVID-19

In light of the COVID-19 outbreak around the world and to ensure the health and safety of our guests and team, we will be working closely with our partners to ensure that they meet safety requirements that we are happy with. We shall continue to monitor changes in travel to the destinations in which we operate, taking advice from the World Health Organisation and other departments around the world. If there are any changes to your escape, you will be contacted directly to discuss your options. Should you contract COVID-19, we advise you not to travel. No refund will be given for those individuals unable to travel due to contracting the virus. We strongly recommend getting the correct travel insurance which can, in some circumstances, cover any losses.

Before booking your retreat, please check out your retreat destinations COVID-19 travel policy and ensure you have the correct level of protection from the virus. Some countries require proof of vaccinations, so ensure you are permitted to travel before booking your escape with us.

IN DEPTH TERMS & CONDITIONS

Please find below our terms and conditions for XPLR RETREATS. Please read them carefully and do not hesitate to contact us if you have any questions. This document must be signed prior to booking an escape with XPLR RETREATS. You will be given this electronically before transferring your deposit.

By accessing this website, you are agreeing to be bound by these website Terms and Conditions, which may be amended from time to time, and all applicable laws and regulations.

 

AGREEMENT TO T&CS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and XPLR Retreats, doing business as XPLR Retreats ("XPLR Retreats", “we”, “us”, or “our”), concerning your access to and use of the www.xplr-retreats.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

 

CANCELLATION / REFUND POLICY

To be able to participate in XPLR Retreats you must have a valid passport and be able to travel to our destinations independently. Flights are not included. Payments must be made in full, 90 days before the due date of the first day of the start date, at the most. Failure to complete all payments by the due date will result in loss of entry to XPLR Retreats and no refunds will be given.

We highly recommend holiday insurance for all clients. This must be bought independently as it is not included in the retreat price. It is your responsibility to read and understand our cancellation policy before making a reservation. Please consider purchasing travel cancellation insurance.

By agreeing to these terms and conditions you are stating that:

  1. You have been authorised to use the Debit/Credit card.
  2. You will not charge back, dispute, reverse any payments.
  3. We reserve the right to ban any account/person without notice for any reason.
  4. You have read the Terms & Conditions and agree.
  5. You agree to be bound to the Terms and Conditions and everything listed above and below. No deposit refunds will be granted.

 

DEPOSITS

A non-refundable £500 sum is required to secure your booking with us. Due to the exclusivity and limited availability, deposits are non-refundable, and no refunds will be provided in any circumstance.

GUEST CANCELLATION POLICY

If you need to cancel with XPLR Retreats, cancellation fees will apply. All cancellations must be received in writing. Please read, understand, and agree to the following policy.

CANCELLING WITHIN 24 HOURS OF MAKING A BOOKING

Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason. Please understand that in anticipation of your retreat, we will be making non-refundable bookings on your behalf and therefore encounter non-retrievable costs, should you cancel, hence the cancellation policy set out above.

 

ADDITIONAL CANCELLATION NOTES TO CONSIDER

We do not offer credit for arriving late or leaving early. A guest can change to another retreat 150 days or before your retreat start date for an additional fee of £250, on top of your retreat balance.  Please note the retreat must have availability and other costs may be involved.

No refund will be provided for premature leaving of the retreat or failure to arrive at the retreat for any reason.

No refund will be provided for only part of a booking. For example, if a room is booked for two guests who are sharing and one guest is unable to attend, the booking would need to be cancelled as a whole for the above refund policy to apply. In some cases, we may be able to find a solution which allows the other traveller to still join in with the retreat, however, additional fees may be incurred at this stage. No refund will be provided for any room downgrades, after the 24hrs from the point of booking has lapsed.

If paying via instalments, the above conditions will apply based on the entire price of your booking and not just on any instalments paid.

All retreat payments are due 90-days prior to the start date of the booked retreat, unless otherwise specified. Clients whose balances are not received by the 90-day deadline, risk forfeiting their retreat booking.

 

CANCELLATIONS MADE BY XPLR RETREATS

We reserve the right to cancel or postpone a retreat. If we cancel or postpone a retreat, we will use reasonable efforts to reschedule the cancelled or postponed retreat to within 12 months from its original start date. Deposits paid by guests for a cancelled or postponed retreat shall be transferred across to the new booking.

Retreat venue, dates and locations are subject to change without prior notice. XPLR Retreats reserves the right to change any instructors/trainers for each retreat or event without notice. XPLR Retreats will let you know as soon as possible of any changes made to your bookings.

If for any reason XPLR Retreats must cancel or change the start date of any retreat, for any reason whatsoever, you’re entitled to transfer the sums paid to another scheduled retreat or obtain a credit note to use against future retreats, yet to be arranged.

XPLR Retreats is not responsible for your expenses incurred in preparation for any cancelled retreat such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.

Use of credit or debit cards will not incur a surcharge if payments are cleared in full at the time of booking.

 

INSTALMENT PAYMENTS

XPLR Retreats allows you to pay for your retreat over three instalments in accordance with the date of purchase and retreat schedule. Failure to meet the instalment deadline could result in failure to attend your retreat.

 

CHANGING RETREATS

If you would like to change your booking week more than 150 days before the start date of your booked week, this is possible, however you will incur a £250 administration charge per booking plus any difference in the rate of the new retreat (if applicable). We charge an administrative fee due to our commitments with our partners and cannot be held responsible should you wish to change your retreat.

 

ADDITIONAL PAYMENTS

Please note that payment for additional items at the retreat, such as treatments, transfers, meals/drinks out of package, as well as any other unorganised activities not provided by XPLR Retreats can be paid for by debit or credit card or local currency. XPLR Retreats will not be held liable for any additional costs which are incurred by you during your time with us.

 

TOURIST TAX

Some of our retreats are in countries where guests may be required to pay a tourist tax. This fee is usually calculated per person, per night of stay. You will need to pay this upon check in or check out at the resort, if applicable, unless included in your package rate – which we will tell you about.

 

FLIGHTS & TRANSFERS

Flights must be booked independently, following confirmation of your retreat. If booking online, please await confirmation from the XPLR Retreats before booking any flights. It is advisable to book your flights as soon as they become available for the cheapest rate. We will advise you what flight the team have booked, giving you the opportunity to travel at the same time.

Transfers to and from the airport on some retreats are included in your package. This information will be found within the ‘what is included’ section on each retreat destination and details will be released once we have been given them by the resort. Failure to miss the scheduled transfers, will result in you organising your own transportation, at an additional cost which XPLR Retreats will not be held responsible for. Please ensure that we have details of your travel arrangements, so we can try to operate a smooth transition to resort.

Please be aware that if you decide to book your transfers through a 3rd party, your flight details will often be required by the week before your departure at the latest. Failure to do so may result in waiting extended periods of time for the next available group transfer.

Clients who book transfers independently will need to take full responsibility for their transfers but as a word of warning, most of our retreat destinations are located remote areas and people arriving on independent transfers often get lost and charged more for the journey. It is safer and more cost effective to travel together, where possible.

 

ALCOHOL, SMOKING & RECREATIONAL DRUGS

XPLR Retreats is a smoke and recreational drug free retreat.

If you wish to smoke (including e-cigarettes and vaping) please adhere to the designated smoking areas outside the villa, outside the retreat. Anyone found smoking in the property or outside of the designated zones given by the hotel may be asked to leave the retreat and no refund shall be given.

There will be ZERO tolerance when it comes to recreational drugs. These are not to be brought to the retreat. Any guests found under the influence of recreational drugs will be asked to leave the retreat at their own cost. No refunds will be given.

Alcohol is permitted in moderation on the retreat; however, we ask that you do not travel with alcohol and only consume drinks which you buy or are in your package during your stay with us. Whilst we want everyone to enjoy themselves, we respectfully ask that you consider your retreat hosts and other retreat participants, as well as other holiday makers at the resort. Anyone who is intoxicated in a manner which we deem to be inappropriate, could forfeit the retreat and be asked to leave with immediate effect. No refunds will be given, and you will need to find your own way home, at no cost to us.

 

ROOM DAMAGES

If you damage your room or any of the property during your stay, we will automatically deduct the cost of repairing / replacing / redecorating from your registered card.

 

COMMENTS & COMPLAINTS

If you feel unwell or are not happy with the retreat for any reason, please tell your Retreat Host immediately and we will endeavour to take whatever action is required. Please bear in mind that any claims may be rejected if we are not given the opportunity to put matters right during your stay. We endeavour to provide you with the best possible experience on your retreats and as a small business, negative feedback can have damaging effects. Please bear this in mind and provide us with the opportunity to rectify any issues before taking to social media or leaving unfair reviews.

 

ROOM SHARE

For solo travellers, there may be the option to share a room with another retreat guest, of the same sex, unless otherwise specified. Please send us an email, hello@xplr-retreats.com, and we will discuss the options available to you.

XPLR Retreats takes no responsibility for the actions of the person/s with whom you ‘room share’. If for whatever reason you are unhappy with your ‘room share’ including but not limited to: clash of personalities; disagreements; snoring; other annoying habits etc, XPLR Retreats cannot be held responsible.

 

ADDING ANOTHER GUEST TO YOUR BOOKING

Should you wish to travel with friends or relatives, we would ask that you book at the same time - where possible – to avoid disappointment. Adding a guest to your booking may be possible, however, please note that we often have a maximum capacity of guests that we can accommodate. Should we have not reached full capacity, we would be happy to add a guest to your booking. Please confirm any changes as soon as possible. Places are only secured on receipt of payment.

 

XPLR RETREATS LOYALTY SCHEME

Anyone who books and stays with XPLR Retreats will benefit from discounts on future stays, including a ‘refer a friend’ bonus, after leaving reviews on Google. Signing up to the newsletter is a great way to keep up to date with our latest retreats and adventures.

The discounts are ONLY off the room rate and not off any extras such as additional bookable activities. This scheme is not in conjunction with any other offer which you may see on social media. In order to be registered into the loyalty scheme you must make the booking in your name and personally attend the retreat.

 

PROMOTIONS & DISCOUNTS

If you have a promotion code, please use this at the time of booking. Discounts cannot be applied once your booking has been made and no refunds will be given. Discounts may vary from time to time and XPLR Retreats will not offer any refunds for differences in discounts once your booking has been made.

 

USE OF IMAGERY – PHOTOGRAPHY / VIDEOGRAPHY

You hereby grant to XPLR Retreats the absolute and irrevocable right, and unrestricted permissions to use photographic portraits/images/videos in which you feature that are taken during the retreat to use/republish/copyright, etc. for commercial use in association with XPLR Retreats. You hereby release and discharge XPLR Retreats from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

 

INFORMED CONSENT FORM

You will agree to sign a health waiver with XPLR Retreats at the time of booking, noting any health issues, including allergies. This document must be answered in full. It is your duty to notify us of any changes to your health thereafter.

 

GENERAL WAIVER

You acknowledge that during any trip with XPLR Retreats you participate voluntarily in any and all activities arranged, and insofar as is legally permissible, you surrender your right to any cause of action against XPLR Retreats, their agents, contractor’s, employee’s and directors, arising from any loss or damage to any person or property that occurs during a XPLR Retreat up to and including death.

If you are currently pregnant, or under medical or psychiatric supervision, you must provide a doctor’s certificate confirming your fitness to travel and take part in the retreat as well as notifying XPLR Retreats. XPLR Retreats is unfortunately not suitable for those with psychiatric or deep emotional issues or those looking for counselling or therapy, as our team are not professionally qualified in these areas. Our team are also not medically trained and do not know your medical history so cannot offer any specific medical advice whilst at the retreat.

Our retreat is not suitable for children under the age of 18 years or for people with physical disabilities that cannot take care or responsibility for themselves as we do not have the resources or expertise. There are areas of the retreat that people with mobility issues may not be able to access. Please take this into consideration.

Should you be unsure of your overall health, fitness and wellbeing, please consult a doctor before and make sure you are cleared by a medical professional before you commit to taking part in our active retreats.

 

INDEMNITY

You agree to fully indemnify without limitation any trainer(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for XPLR Retreats.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

 

ASSUMPTON OF RISK

By agreeing to these terms and conditions, I/we state that I/we wish to participate in the XPLR Retreats and all the activities, which could include but are not limited to: aerobic & resistance exercise, yoga, pilates, running, walks, cycling, beach games, swimming (pool, sea and river), snorkelling, scuba diving and therapy treatments such as massage. I/we realise that my/our participation involves the risk of injury and even the possibility of death. Furthermore, I/we confirm that I/we are voluntarily engaging in an acceptable level of exercise and XPLR Retreats are not responsible for any injuries or losses incurred whilst at the retreat, after the retreat or during the transfer.

If I/we suffer with any health conditions including but not limited to the following, I/we confirm that I/we have either consulted with a doctor before participating in physical activity or I/we am accepting full responsibility for my/our own health and I/we acknowledge the risk involved.

Please advise XPLR Retreats, if you have / have had or are recovering from any of the following conditions. Bone or joint or back problem/pain; high or low blood pressure; surgery or recent injury; Diabetes or any other metabolic disease; raised cholesterol; heart condition; cancer; pain in your chest when you do physical exercise; unusual shortness of breath at rest or with mild exertion; pregnant; spells of severe dizziness or have lost consciousness; Epilepsy; angina.

 

EXCLUSIONS

Due to mechanical faults, weather conditions, or what insurers call ‘Acts of God’, some amenities may be unavailable on your retreat. Very occasionally, we may have to vary the advertised programme due to staff sickness or other unforeseen problems, in which case we will always try to provide an equivalent replacement. This may not always be possible. For example, if your Trainer or Host becomes unwell on the retreat some activities may well be cancelled. Please note that most activities and fitness sessions will take place outside, so if the heavens open, these will still go ahead, unless deemed unsafe to do so. Clearly, we will always do our very best to make sure all activities go ahead if possible. We would also like to point out that the XPLR Retreats team can change at any time and although we will always endeavour to have a suitable replacement there will be no compensation for the change in team member.

In the event of one of the team members becoming injured, ill or any emergency situation that forces them to leave the retreat, then this may impact on the retreat plan, in terms of the fitness classes or talks being cancelled. We will do whatever we can to adapt to the situation and reduce the impact this may have on your retreat experience. The retreat will continue to run however things will be adjusted to reflect the team situation. There will be no refunds or compensation to reflect the change in team situation.

 

XPLR RETREATS WILL NOT ACCEPT LIABILITY FOR:

Any of the above events, or others beyond our control.

Loss, injury, or damage (to you) or your personal property.

Physical, medical, or psychiatric conditions developing during or after your retreat.

Check that your holiday insurance policy covers these and other contingencies.

 

 

TRIP POSTPONEMENT

As a company based in the UK, we follow The Foreign & Commonwealth Office (FCO). If they advise against ‘all but essential travel’ or ‘all travel’ to a destination, we will postpone or amend itineraries in accordance with this advice. If your escape is affected as a result of these changes, we will contact you directly. If we need to postpone your trip for any other reason, we will be in touch no less than 20 days before your departure dates, although we will always endeavour to give as much notice as possible.

 

IN THE EVENT OF BUSINESS CLOSURE

Should XPLR Retreats decide to cease trading, for whatever reason, we will inform you as soon as possible but will endeavour to complete any scheduled future retreats before closing the business. XPLR Retreats will give a full refund should they be unable to operate the business and therefore cancel forthcoming escapes. XPLR Retreats will refund the retreat cost if applicable, however will not pay for any loss with flights or any other costs incurred outside of the retreat package.

 

INTERLLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of The United Kingdom, The United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. PRIVACY POLICY

We care about data privacy and security. By using the Site, you agree to be bound by our Privacy Policy posted on the Site, which is incorporated into these Terms of Use. If you access the Site from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United Kingdom, then through your continued use of the Site, you are transferring your data to the United Kingdom, and you agree to have your data transferred to and processed in the United Kingdom.

TERM AND TERMINATION

These Terms of Use shall remain in full force and effect while you use the Site. If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

MODIFICATIONS TO THE SITE

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. CORRECTIONS MADE TO THE SITE

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

ELECTRONIC COMMUNICATIONS, TRANSACTIONS & SIGNATURES

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. MISCELLANEOUS

These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Terms of Use or use of the Site. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defences you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.

This contract is entered into under the laws of the United Kingdom and in agreeing to these terms and condition you are doing so on behalf of yourself, and any other parties included in your booking.

Please find below our terms and conditions for XPLR RETREATS. Please read them carefully and do not hesitate to contact us if you have any questions. This document must be signed prior to booking an escape with XPLR RETREATS. You will be given this electronically when you hit the ‘book now’ button.

By accessing this website, you are agreeing to be bound by these website Terms and Conditions, which may be amended from time to time, and all applicable laws and regulations.

 

AGREEMENT TO T&CS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and XPLR Retreats, doing business as XPLR Retreats ("XPLR Retreats", “we”, “us”, or “our”), concerning your access to and use of the www.xplr-retreats.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

 

CANCELLATION / REFUND POLICY

To be able to participate in XPLR Retreats you must have a valid passport and be able to travel to our destinations independently. Flights are not included. Payments must be made in full, 60 days before the due date of the first day of the start date, at the most. Failure to complete all payments by the due date will result in loss of entry to XPLR Retreats and no refunds will be given.

We highly recommend holiday insurance for all clients. This must be bought independently as it is not included in the retreat price. It is your responsibility to read and understand our cancellation policy before making a reservation. Please consider purchasing travel cancellation insurance.

By agreeing to these terms and conditions you are stating that:

  1. You have been authorised to use the Debit/Credit card.
  2. You will not charge back, dispute, reverse any payments.
  3. We reserve the right to ban any account/person without notice for any reason.
  4. You have read the Terms & Conditions and agree.
  5. You agree to be bound to the Terms and Conditions and everything listed above and below. No deposit refunds will be granted.

 

DEPOSITS

A non-refundable £500 sum that is required to secure your booking with us. Due to the exclusivity and limited availability, deposits are non-refundable and no refunds will be provided in any circumstance.

GUEST CANCELLATION POLICY

If you need to cancel with XPLR Retreats, cancellation fees will apply. All cancellations must be received in writing. Please read, understand and agree to the following policy.

CANCELLING WITHIN 24 HOURS OF MAKING A BOOKING

Once you have confirmation of your booking you have a further 24hrs to cancel and obtain a full refund, including deposit. After this period, the following conditions will apply.

150 DAYS OR MORE

A full refund minus 5% admin charge (5% of the total retreat) will be provided for all cancellations up to 150 days prior to start day of the booked retreat. This excludes the £500 per person deposit which is non-refundable.

BETWEEN 149-120 DAYS

A 50% refund will be provided on cancellations between 120-149 days prior to the start date of the booked retreat. This excludes the £500 per person deposit which is non-refundable.

BETWEEN 119-90 DAYS

A 25% refund will be provided on cancellations between 90-119 days prior to the start date of the booked retreat. This excludes the £500 per person deposit which is non-refundable.

LESS THAN 90 DAYS

No refund will be provided on cancellations between 89-0 days prior to the start date of the booked. Cancellations less than 90 days before the start date are non-refundable and will result in 100 % loss of revenue.

Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason. Please understand that in anticipation of your retreat, we will be making non-refundable bookings on your behalf and therefore encounter non-retrievable costs, should you cancel, hence the cancellation policy set out above.

 

ADDITIONAL CANCELLATION NOTES TO CONSIDER

 

We do not offer credit for arriving late or leaving early. A guest can change to another retreat 150 days or before your retreat start date for an additional fee of £250, on top of your retreat balance.  Please note the retreat must have availability and other costs may be involved.

No refund will be provided for premature leaving of the retreat or failure to arrive at the retreat for any reason.

No refund will be provided for only part of a booking. For example, if a room is booked for two guests who are sharing and one guest is unable to attend, the booking would need to be cancelled as a whole for the above refund policy to apply. In some cases, we may be able to find a solution which allows the other traveller to still join in with the retreat, however, additional fees may be incurred at this stage. No refund will be provided for any room downgrades, after the 24hrs from the point of booking has lapsed.

If paying via instalments, the above conditions will apply based on the entire price of your booking and not just on any instalments paid.

If paying via instalments, an additional 5% will be charged on all stage payments, for administration purposes.

All retreat payments are due 60-days prior to the start date of the booked retreat, unless otherwise specified. Clients whose balances are not received by the 60-day deadline, risk forfeiting their retreat booking.

 

CANCELLATIONS MADE BY XPLR RETREATS

We reserve the right to cancel or postpone a retreat. If we cancel or postpone a retreat, we will use reasonable efforts to reschedule the cancelled or postponed retreat to within 24 months from its original start date. Deposits paid by guests for a cancelled or postponed retreat shall be transferred across to the new booking.

Retreat venue, dates and locations are subject to change without prior notice. XPLR Retreats reserves the right to change any instructors/trainers for each retreat or event without notice. XPLR Retreats will let you know as soon as possible of any changes made to your bookings.

If for any reason XPLR Retreats must cancel or change the start date of any retreat, for any reason whatsoever, you’re entitled to transfer the sums paid to another scheduled retreat or obtain a credit note to use against future retreats, yet to be arranged.

XPLR Retreats is not responsible for your expenses incurred in preparation for any cancelled retreat such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.

Use of credit or debit cards will not incur a surcharge if payments are cleared in full at the time of booking.

INSTALLMENT PAYMENTS

XPLR Retreats allows you to pay for your retreat over up to 3 instalments in accordance with the relevant date of purchase and retreat schedule.

If paying via instalments, due to administration an additional 5% will be charged on all stage payments.

 

CHANGING RETREATS

If you would like to change your booking week more than 150 days before the start date of your booked week, this is possible, however you will incur a £300 administration charge per booking plus any difference in the rate of the new retreat (if applicable). We charge an administrative fee due to our commitments with our partners and cannot be held responsible should you wish to change your retreat.

 

ADDITONAL PAYMENTS

Please note that payment for additional items at the retreat, such as treatments, transfers, meals/drinks out of package, as well as any other unorganised activities not provided by XPLR Retreats can be paid for by debit or credit card or local currency. XPLR Retreats will not be held liable for any additional costs which are incurred by you during your time with us.

 

 

TOURIST TAX

Some of our retreats are located in countries where guests may be required to pay a tourist tax. This fee is usually calculated per person, per night of stay. You will need to pay this upon check in or check out at the resort, if applicable, unless included in your package rate – which we will tell you about.

 

FLIGHTS & TRANSFERS

Flights must be booked independently, following confirmation of your retreat. If booking online, please await confirmation from the XPLR Retreats before booking any flights. It is advisable to book your flights as soon as they become available for the cheapest rate. Should you be travelling from the UK, we can recommend a suitable flight and there is the option to travel together as a team and with your host, in some circumstances.

Transfers to and from the airport on some retreats are included in your package. This information will be found within the ‘what is included’ section on each retreat destination. Failure to miss the scheduled transfers, will result in you organising your own transportation, at an additional cost which XPLR Retreats will not be held responsible for.

Please be aware that if you decide to book your transfers through a 3rd party, your flight details will often be required by the week before your departure at the latest. Failure to do so may result in waiting extended periods of time for the next available group transfer.

Clients who book transfers independently will need to take full responsibility for their transfers but as a word of warning, most of our retreat destinations are located remote areas and people arriving on independent transfers often get lost and charged more for the journey. It is safer and more cost effective to travel together, where possible.

 

ALCOHOL, SMOKING & RECREATIONAL DRUGS

XPLR Retreats is a smoke and recreational drug free retreat.

If you wish to smoke (including e-cigarettes and vaping) please adhere to the designated smoking areas outside the villa, outside the retreat. Anyone found smoking in the property or outside of the designated zones given by the hotel may be asked to leave the retreat and no refund shall be given.

There will be ZERO tolerance when it comes to recreational drugs. These are not to be brought to the retreat. Any guests found under the influence of recreational drugs will be asked to leave the retreat at their own cost. No refunds will be given.

Alcohol is permitted in moderation on the retreat, however, we ask that you do not travel with alcohol and only consume drinks which you buy during your stay with us. Whilst we want everyone to enjoy themselves, we respectfully ask that you consider your retreat hosts and other retreat participants, as well as other holiday makers at the resort. Anyone who is intoxicated in a manner which we deem to be inappropriate, could forfeit the retreat and be asked to leave with immediate effect. No refunds will be given and you will need to find your own way home, at no cost to us.

 

ROOM DAMAGES

If you damage your room or any of the property during your stay, we will automatically deduct the cost of repairing / replacing / redecorating from your registered card.

 

COMMENTS & COMPLAINTS

If you feel unwell or are not happy with the retreat for any reason, please tell your Retreat Host immediately and we will endeavour to take whatever action is required. Please bear in mind that any claims may be rejected if we are not given the opportunity to put matters right during your stay. We endeavour to provide you with the best possible experience on your retreats and as a small business, negative feedback can have damaging effects. Please bear this in mind and provide us with the opportunity to rectify any issues before taking to social media or leaving unfair reviews.

 

ROOM SHARE

For solo travellers, there may be the option to share a room with another retreat guest, of the same sex, unless otherwise specified. Please send us an email, hello@xplr-retreats.com, and we will discuss the options available to you.

XPLR Retreats takes no responsibility for the actions of the person/s with whom you ‘room share’. If for whatever reason you are unhappy with your ‘room share’ including but not limited to: clash of personalities; disagreements; snoring; other annoying habits etc, XPLR Retreats cannot be held responsible.

 

ADDING ANOTHER GUEST TO YOUR BOOKING

Should you wish to travel with friends or relatives, we would ask that you book at the same time - where possible – to avoid disappointment. Adding a guest to your booking may be possible, however, please note that we often have a maximum capacity of guests that we can accommodate. Should we have not reached full capacity, we would be happy to add a guest to your booking. Please confirm any changes as soon as possible. Places are only secured on receipt of payment.

 

 

XPLR RETREATS LOYALTY SCHEME

Anyone who books and stays with XPLR Retreats will benefit from discounts on future stays, including a ‘refer a friend’ bonus, after leaving reviews on Google. Signing up to the newsletter is a great way to keep up to date with our latest retreats and adventures.

The discounts are ONLY off the room rate and not off any extras such as additional bookable activities. This scheme is not in conjunction with any other offer which you may see on social media. In order to be registered into the loyalty scheme you must make the booking in your name and personally attend the retreat.

 

PROMOTIONS & DISCOUNTS

If you have a promotion code, please use this at the time of booking. Discounts can not be applied once your booking has been made and no refunds will be given. Discounts may vary from time to time and XPLR Retreats will not offer any refunds for differences in discounts once your booking has been made.

 

USE OF IMAGERY – PHOTOGRAPHY / VIDEOGRAPHY

You hereby grant to XPLR Retreats the absolute and irrevocable right, and unrestricted permissions to use photographic portraits/images/videos in which you feature that are taken during the retreat to use/republish/copyright, etc. for commercial use in association with XPLR Retreats. You hereby release and discharge XPLR Retreats from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

 

INFORMED CONSENT FORM

You will agree to sign a health waiver with XPLR Retreats at the time of booking, noting any health issues, including allergies. This document must be answered in full. It is your duty to notify us of any changes to your health thereafter.

 

GENERAL WAIVER

You acknowledge that during any trip with XPLR Retreats you participate voluntarily in any and all activities arranged, and insofar as is legally permissible, you surrender your right to any cause of action against XPLR Retreats, their agents, contractor’s, employee’s and directors, arising from any loss or damage to any person or property that occurs during a XPLR Retreat up to and including death.

If you are currently pregnant, or under medical or psychiatric supervision, you must provide a Doctor’s certificate confirming your fitness to travel and take part in the retreat as well as notifying XPLR Retreats. XPLR Retreats is unfortunately not suitable for those with psychiatric or deep emotional issues or those looking for counselling or therapy, as our team are not professionally qualified in these areas. Our team are also not medically trained and do not know your medical history so cannot offer any specific medical advice whilst at the retreat.

Our retreat is not suitable for children under the age of 18 years or for people with physical disabilities that cannot take care or responsibility for themselves as we do not have the resources or expertise. There are areas of the retreat that people with mobility issues may not be able to access. Please take this into consideration.

Should you be unsure of your overall health, fitness and wellbeing, please consult a doctor before and make sure you are cleared by a medical professional before you commit to taking part in our active retreats.

 

INDEMNITY

You agree to fully indemnify without limitation any trainer(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for XPLR Retreats.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

 

ASSUMPTON OF RISK

By agreeing to these terms and conditions, I/we state that I/we wish to participate in the XPLR Retreats and all the activities, which could include but are not limited to: aerobic & resistance exercise, yoga, pilates, running, walks, indoor cycling, beach games, tennis, sauna, swimming (pool, sea and river), white water rafting and therapy treatments such as massage. I/we realise that my/our participation involves the risk of injury and even the possibility of death. Furthermore, I/we confirm that I/we are voluntarily engaging in an acceptable level of exercise and XPLR Retreats are not responsible for any injuries or losses incurred whilst at the retreat, after the retreat or during the transfer.

If I/we suffer with any health conditions including but not limited to the following, I/we confirm that I/we have either consulted with a doctor before participating in physical activity or I/we am accepting full responsibility for my/our own health and I/we acknowledge the risk involved.

Please advise XPLR Retreats, if you have / have had or are recovering from any of the following conditions. Bone or joint or back problem/pain; high or low blood pressure; surgery or recent injury; Diabetes or any other metabolic disease; raised cholesterol; heart condition; cancer; pain in your chest when you do physical exercise; unusual shortness of breath at rest or with mild exertion; pregnant; spells of severe dizziness or have lost consciousness; Epilepsy; angina.

 

EXCLUSIONS

Due to mechanical faults, weather conditions, or what insurers call ‘Acts of God’, some amenities may be unavailable on your retreat. Very occasionally, we may have to vary the advertised programme due to staff sickness or other unforeseen problems, in which case we will always try to provide an equivalent replacement. This may not always be possible. For example, if your Personal Trainer or Yoga Instructor becomes unwell on the retreat some activities may well be cancelled. Please note that most activities and fitness sessions will take place outside, so if the heavens open, these will still go ahead, unless deemed unsafe to do so. Clearly, we will always do our very best to make sure all activities go ahead if possible. We would also like to point out that the XPLR Retreats team can change at any time and although we will always endeavour to have a suitable replacement there will be no compensation for the change in team member.

In the event of one of the team members becoming injured, ill or any emergency situation that forces them to leave the retreat, then this may impact on the retreat plan, in terms of the yoga or fitness classes or talks being cancelled. We will do whatever we can to adapt to the situation and reduce the impact this may have on your retreat experience. The retreat will continue to run however things will be adjusted to reflect the team situation. There will be no refunds or compensation to reflect the change in team situation.

 

XPLR RETREATS WILL NOT ACCEPT LIABILITY FOR:

Any of the above events, or others beyond our control.

Loss, injury, or damage (to you) or your personal property.

Physical, medical, or psychiatric conditions developing during or after your retreat.

Check that your holiday insurance policy covers these and other contingencies.

 

 

TRIP POSTPONEMENT

As a company based in the UK, we follow The Foreign & Commonwealth Office (FCO). If they advise against ‘all but essential travel’ or ‘all travel’ to a destination, we will postpone or amend itineraries in accordance with this advice. If your escape is affected as a result of these changes, we will contact you directly. If we need to postpone your trip for any other reason, we will be in touch no less than 20 days before your departure dates, although we will always endeavour to give as much notice as possible. Be assured that if your trip is postponed, for any reason, you will still get the adventure you paid for and this will remain 100% financially protected. Our team will allocate you a holding spot on another retreat of your choice.

 

IN THE EVENT OF BUSINESS CLOSURE


Should XPLR Retreats decide to cease trading, for whatever reason, we will inform you as soon as possible but will endeavour to complete any scheduled future retreats before closing the business. XPLR Retreats will give a full refund should they be unable to operate the business and therefore cancel forthcoming escapes. XPLR Retreats will refund the retreat cost if applicable, however will not pay for any loss with flights or any other costs incurred outside of the retreat package.

PRIVACY POLICY

This contract is entered into under the laws of the United Kingdom and in agreeing to these terms and condition you are doing so on behalf of yourself, and any other parties included in your booking.
